# Terms of Service

Acceptance of Terms These Terms of Service (“Terms”) govern your use of the Itinarii mobile application and related services (the “Service”), operated by Itinarii Inc. (“Itinarii”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service. --- ## 2. Eligibility You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. --- ## 3. Account Registration You may create an account using: - Email and password - Apple Sign In - Google Sign In You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms. --- ## 4. Description of the Service Itinarii provides curated travel itineraries, map features, downloadable itinerary files, and related planning tools. The Service is provided for informational purposes only. Itinarii is not a travel agency, booking provider, or tour operator. We do not guarantee availability, pricing, safety conditions, transportation schedules, or third-party services referenced in itineraries. Travel conditions may change without notice. You are responsible for verifying all travel details before making bookings or travel decisions. --- ## 5. Subscriptions and Payments Certain features require a paid subscription. ### In-App Purchases (iOS) Subscriptions purchased within the iOS app are processed by Apple. Billing, renewal, cancellation, and refunds are governed by Apple’s terms and policies. Subscriptions renew automatically unless canceled at least 24 hours before the end of the billing period. You may manage or cancel subscriptions through your Apple account settings. ### Web Purchases Subscriptions purchased via the website are processed by Stripe and managed through RevenueCat. We do not store full payment card details. Prices may change from time to time. Price changes will not affect your current billing period. ## 5A. Premium Features Premium subscriptions provide access to enhanced features, which may include expanded itinerary access, additional tools, downloadable materials, and newly released itineraries. Feature availability may change over time. While we may communicate anticipated updates or content releases, we do not guarantee that new content will be released on a specific schedule. We reserve the right to modify, add, or remove features at any time. Changes to features do not entitle users to refunds, except where required by applicable law. --- ## 6. Refunds Refunds for in-app purchases are handled by Apple. Refund requests for web purchases are handled in accordance with applicable law. Except where required by law, subscription fees are non-refundable. --- ## 7. User Content You may save itineraries and related data within your account. You retain ownership of your content. By using the Service, you grant Itinarii a limited, non-exclusive license to store and process your content solely for the purpose of operating and improving the Service. You are responsible for ensuring that your content does not violate any laws or third-party rights. --- ## 8. Intellectual Property All content provided by Itinarii, including itinerary structures, design elements, branding, text, graphics, and software code, is owned by Itinarii Inc. or its licensors. You may not reproduce, distribute, modify, scrape, or commercially exploit any portion of the Service without prior written permission. --- ## 9. Acceptable Use You agree not to: - Use the Service for unlawful purposes - Attempt to reverse engineer, disrupt, or interfere with the Service - Scrape, copy, or extract itineraries at scale - Circumvent subscription controls - Interfere with security features We may suspend or terminate accounts that violate these Terms. --- ## 10. Third-Party Services The Service integrates with third-party providers including Apple, Google, Stripe, RevenueCat, Firebase, and Mapbox. We are not responsible for the actions, content, or policies of third-party services. --- ## 11. Disclaimer of Warranties The Service is provided on an “as is” and “as available” basis. We do not guarantee that: - The Service will be uninterrupted or error-free - Information will always be complete or accurate - Travel recommendations will be suitable for your specific circumstances Travel involves inherent risks. You assume full responsibility for your travel decisions. --- ## 12. Limitation of Liability To the maximum extent permitted by law, Itinarii Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to Itinarii in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations. In those cases, liability is limited to the minimum extent permitted by law. --- ## 13. Indemnification You agree to indemnify and hold harmless Itinarii Inc., its officers, directors, and affiliates from any claims, damages, losses, or expenses arising from: - Your use of the Service - Your violation of these Terms - Your infringement of any third-party rights --- ## 14. Account Termination You may delete your account at any time within the app. We may suspend or terminate your access if you violate these Terms. --- ## 15. Changes to the Service We may modify, update, or discontinue features of the Service at any time. We are not liable for service interruptions or feature changes. --- ## 16. Governing Law These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Disputes shall be resolved in the courts of British Columbia, unless otherwise required by applicable consumer protection law. --- ## 17.
